- Nature of the Products: The webshop offers unique fine art creations (original paintings) and, occasionally, their numbered, limited-edition reproductions (prints) for purchase.
- Uniqueness: Only 1 piece of each original painting is available. If two customers attempt to purchase the same painting at the same time, the Seller will process the transaction based on the order of arrival.
- Prices: Prices displayed in the webshop are in Hungarian Forints (HUF). The Seller is exempt from VAT (subject to personal tax exemption - "alanyi adómentes" / AAM), therefore the displayed prices do not contain VAT and represent the final total amount payable. Prices do not include delivery costs, which will be added to the final total during the checkout process.
3. Conditions of Purchase, Scope of Customers
3.1. The Service Provider (Seller) falls under the scope of the Act on the Itemized Tax of Small Taxpayer Enterprises (KATA). Consequently, the Service Provider exclusively serves private individuals (consumers) and issues invoices solely to private individuals.
3.2. By placing an order in the Webshop, the Customer declares and warrants that they are acting as a private individual (natural person) during the purchase, that the purchased products/services will not be used within the scope of an individual entrepreneurship, economic, or corporate activity, and that they do not request an invoice containing a corporate tax number.
3.3. If, after the order is submitted, it becomes apparent from the billing details or other indications from the Customer that the Customer is not a private individual (e.g., provides a tax number, specifies a company name for billing), the Service Provider is entitled to refuse to enter into the contract, cancel the order, and fully refund any amount that may have already been paid by the Customer. The Service Provider shall not be held liable for any damages resulting from the provision of incorrect data or data that violates legal regulations.
4. Ordering Process and Conclusion of the Contract
4.1. The Customer, acting as a consumer, places the selected painting into the "Cart".
4.2. On the Cart page, the Customer provides the shipping and billing details, and selects the preferred shipping and payment methods.
4.3. Before finalizing the order, the Customer is required to accept these Terms and Conditions and the Privacy Policy.
4.4. By clicking the "Send Order / Payment" button, the Customer incurs a payment obligation.
4.5. The system sends an automatic confirmation e-mail upon receipt of the order. This e-mail only acknowledges receipt and does not constitute acceptance of the order. The contract concluded between distant parties is established when the Seller sends a separate e-mail explicitly confirming the feasibility of fulfilling the order (commencement of packaging or dispatch).
5. Payment Methods
The following payment methods are available in the webshop:
- Secure Online Credit Card Payment: Barion and PayPal
- Online credit card and other payment methods are processed through the Barion system. Credit card and other payment-related data are not shared with the merchant. The service provider, Barion Payment Zrt., is an institution supervised by the Central Bank of Hungary (Magyar Nemzeti Bank), license number: H-EN-I-1064/2013
- Bank Transfer in Advance: To the bank account number provided in the confirmation e-mail. The painting will be dispatched after the total amount has been credited to the Seller's bank account.
6. Shipping, Packaging, and Delivery
- Secure Packaging: As paintings are fragile works of art, the Seller pays special attention to multi-layered protective packaging (bubble wrap, edge protectors, rigid cardboard, or wooden boxes).
- Shipping Method: Delivery is carried out by MPL / UPScourier service as an insured, fragile package.
- Delivery Deadline: For paintings in stock, dispatch takes place within 1-3 business days from the receipt of payment.
- Obligation of Acceptance: The Customer is obliged to accept the package intact from the courier. If external damage is visible on the packaging, the Customer must request the courier to draw up a damage report (record) and refuse to accept the package. In the absence of a damage report, the Seller cannot accept complaints regarding shipping damages.
7. Right of Withdrawal (Returns)
7.1. 14-day Withdrawal: Pursuant to Government Decree 45/2014 (II. 26.), the Customer, acting as a consumer, has 14 days from the receipt of the painting to withdraw from the purchase without giving any reason.
7.2. Return Costs: In the event of withdrawal, the direct cost of returning the painting shall be borne by the Customer. The Customer must return the painting in secure and fragile packaging similar to the original. The Seller is unable to accept packages returned with cash on delivery (COD).
7.3. Depreciation: If the painting is damaged due to inappropriate packaging or the Customer's fault (e.g., scratched canvas, damaged support structure), the Customer is liable for the resulting depreciation, which the Seller may deduct from the amount to be refunded.
7.4. Exception to the Right of Withdrawal (Custom Orders): If the painting was made to the express request and custom order of the Customer (commissioned art, e.g., custom portrait, specific size and theme), the Customer DOES NOT hold a right of withdrawal, pursuant to Section 29 (1) c) of Government Decree 45/2014 (II. 26.) (in the case of a non-prefabricated product manufactured based on the consumer's instructions or express request).
8. Implied Warranty and Guarantee
8.1. The Seller warrants that the paintings correspond in reality to the photos displayed in the webshop. Minor discrepancies in color shades may occur due to the individual settings of the Customer's monitor/display, which does not constitute defective performance.
8.2. In the case of original creations, the Seller issues and encloses a Certificate of Authenticity with each painting, certifying the authenticity of the artwork and bearing the artist's original signature.
9. Copyrights
9.1. By purchasing the painting, the Customer acquires ownership of the physical artwork.
9.2. All copyrights (including the right of reproduction, digital distribution, or commercial use) remain with the creator (Seller) in all cases, pursuant to Act LXXVI of 1999 on Copyright. The Customer may not reproduce the painting and may not use it for commercial profit without the prior written permission of the artist.
10. Complaint Handling and Disputes
10.1. The Customer may address any complaints to the Seller via the e-mail address provided in Section 1 (kovach.anna@gmail.com). The Seller will investigate the complaint and respond in writing within 30 days.
10.2. If a dispute cannot be settled amicably, the Customer, acting as a consumer, may turn to the competent Arbitration Board (Békéltető Testület) or the consumer protection authority according to their place of residence or stay.
